1. Introduction and effectiveness of the General Conditions

These General Conditions of Sale have as their object the regulation of the purchase of products and services, carried out remotely and made available, by internet, from the site ellegitessuti.it in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions.

The seller of the products and owner of the Site is: Elle&Gi Srl based in Viale Orazio, 4/6, 80047 San Giuseppe Vesuviano (NA) and P.IVA 07077351216. The consumer who accesses the Site to make purchases is required, before the sending the order, to carefully read these General Conditions that have been made available to you on the Site and which will be available at any time by the Customer through the link contained in the footer of the Website on each page.

In the event that the person making purchases on the Site requests an invoice and / or in any case is not a "consumer or user" as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the withdrawal regulations referred to in point 6 of these General Conditions will not apply, nor, more generally, the provisions that pursuant to the same Consumer Code apply only to "consumers". The contracts concluded with Elle&Gi Srl through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

2.Choose and order the Products

The characteristics and the price of the various products on sale on the Site are shown on the page relating to each Product. To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions on the Site. The Customer must add the Product to the "Cart" and, after having read the General Conditions and the Policy Privacy and confirmed their acceptance, you must enter the shipping and billing information, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions. The contract between Elle&Gi Srl and the Customer must be considered concluded with the acceptance of the order by Elle&Gi Srl This acceptance is communicated to the Customer an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs. The Customer will check the confirmation email and if he detects errors in the order he will have 12 hours from the receipt of this email to contact the Customer Service directly from the Site using the specific contact form accessible by the "Contacts" tab.

After this deadline the order will be processed for shipping and no changes will be accepted, without prejudice to the Customer's rights referred to in the following point 6. Once the order has been received, Elle&Gi Srl will check the availability of stocks for order fulfillment. In the event that one or more Products are not available, the Customer Service will send timely communication email to the Customer who, within the following 12 hours, will have the right to reply to confirm the shipment of any further available Products or cancel it.

3. Product information

The information and characteristics relating to the Products are available, with the relevant Product codes, on the Site. The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of difference between the image and the written product sheet, the description of the product sheet always prevails. NB: There may be slight differences in the tone of the fabrics published on the site, following the setting of the monitors of the various devices from which it is displayed (computer, smartphone, iPhone and tablet).

4. Payment and billing methods

4.1 Payment methods

The Customer can pay the price of the Products and the related delivery costs by credit or prepaid card, PayPal or bank transfer.

• PayPal : Once the order is confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or using a card, even prepaid, or in any case according to the methods accepted by Paypal and in compliance with the related conditions.
• Bank transfer : The Customer must make the transfer within 3 days from the date of the order for orders relating to products. If payment does not occur within 3 days, the order will be canceled and the goods made available again for purchase by other customers. The customer who has not made the transfer can be contacted by the customer service in order to clarify whether the cause of the non-credit is due to the customer's will not to confirm the purchase or other causes.

4.2 Invoicing of orders

If the purchase is made by a professional, it will be possible to receive an invoice during the ordering process and entering the billing information including the tax code and / or VAT number. In this case, the invoice will be sent by email to the indicated address. The professional is responsible for the correct insertion of the billing information.

5.Guarantee and defects of conformity

In case of conformity defects of Products sold by Elle&Gi Srl the Customer must immediately contact Customer Service using the appropriate contact form accessible on the Site by "CONTACTS" tab.

6. Right of withdrawal

Pursuant to art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if he qualifies as a "consumer" pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 no. 185 has the right to withdraw from the contract and to return the ordered Products, without any penalty, within 10 (ten) working days from receipt of the Products.
All fabrics BY THE METER are hand cut: YOU HAVE NO RIGHT TO WITHDRAW in the case of cut fabrics or items made exclusively for you (by the meter); they CANNOT BE RETURNED and for incorrect purchase (colors, patterns, etc.).
Check carefully that what you ordered corresponds exactly to what you wanted, bearing in mind any differences in shades that may occur from viewing different monitors.

IMPORTANT: the fabrics must be checked before being processed and packaged because in that case, even in the presence of defects, they cannot be returned. The fabrics are carefully checked before departure in our warehouses, in case some manufacturing imperfection escapes control, please report it using the appropriate contact form accessible on the Site in the "CONTACTS" section (also sending us a photo of the defect found) and, subject to verification by the Elle&Gi Srl, the fabric will be promptly replaced, at our total expense. Elle&Gi Srl will arrange for the collection and delivery of the new fabric as soon as possible. If the fabric is not immediately available we will contact you to give you the delivery date, if you are not willing to accept it, you will be refunded what you paid as soon as we have received the fabric and checked the defect you found.

The transport of returns is charged to the customer in case you want to return a fabric NOT cut and NOT made for himself (per piece). For the return of fabrics that have verified manufacturing defects, the transport is at the expense of Elle&Gi Srl.

The right of withdrawal referred to in the previous article must be exercised by the Customer, under penalty of forfeiture, within 10 (ten) working days from receipt of the products. The above communication can be sent, within the same term, by sending a registered letter with return receipt. to Elle&Gi Srl Viale Orazio, 4/6, 80047 San Giuseppe Vesuviano (NA) or by email to Elle & Gi Srl (elle3gi_srl@libero.it). All returns (which must be perfectly intact) must be authorized by the Elle&Gi Srl Service (elle3gi_srl@libero.it) which will issue the return authorization. Once the return has been authorized, Elle&Gi Srl will provide the Customer with all the instructions for the return. Once the Products have been received (and their integrity has been verified) Elle&Gi Srl will, as soon as possible, credit the Customer with the cost of the returned Products (as indicated on the invoice), withholding the amount of shipping costs which will remain permanently at charged to the Customer or Elle&Gi Srl according to the aforementioned conditions. Without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 n. 185, any dispute connected to these General Conditions will be devolved to the exclusive jurisdiction of the Court of Naples. Pursuant to and for the purposes of articles 1341 and 1342 of the civil code, the Customer declares to have carefully read and understood and to specifically accept the following clauses of the Elle&Gi Srl General Sales Conditions.

7.Shipping

Product prices are inclusive of all taxes and duties. All prices are expressed in Euros.

Shipments in Italy : In all Italy shipping takes place within 48 hours and is free for orders over € 75, for orders under € 75 the cost of shipping is € 7.50.

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate "Shipping Data" field. All purchases will be delivered by express courier from Monday to Friday, excluding holidays and national holidays. Elle&Gi Srl is not responsible for delays that are not foreseeable or not attributable to it. Once the Products have been shipped, the Customer will receive a confirmation email which will include a link to refer to for tracking the shipment. In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within a term of 7 (seven) working days from the day following that in which Elle&Gi Srl confirmed the order to the Customer with a specific order confirmation email. Delivery services active in Italy:

EXPRESS COURIER GLS The service includes 2 delivery attempts at the address indicated at the time of the order. A warning will be left after each step. On the second unsuccessful delivery attempt, the Courier will contact the recipient of the order by telephone at the telephone number indicated, to arrange delivery. If it is not traceable or is absent, the goods will return to the warehouse.

8. Errors and limitations of liability

The information relating to the Products provided through the Site are constantly updated. However, it is not possible to guarantee the complete absence of errors of which therefore Elle&Gi Srl cannot be held responsible, except in cases of willful misconduct or gross negligence.
